This document specifies the rules and conditions for using the Cotty online store (hereinafter: the “Store”), placing orders, and concluding distance sales contracts for products offered in the Store. - Store Organizer

By using the Store and placing an order, the Customer confirms that they have read and accept these Terms.

All prices in the Store are gross prices (including VAT) and are expressed in Polish złoty (PLN) and Euros (EUR). - Payment Methods

Making a payment constitutes acceptance of the sales price and the terms of sale specified in these Terms.

- Delivery Methods
Delivery of ordered products is carried out using the following methods:- InPost parcel lockers
- InPost courier
- DPD courier
- FedEx courier
- ORLEN Parcel
- Delivery Costs
The cost of delivery depends on the weight of the shipment and the destination country and is calculated individually during the ordering process. Delivery is available within Poland and EU countries. - Order Processing Time
The order processing time is 1 to 3 business days from the moment the Store confirms the order. - Delivery Liability
The Store is not responsible for delays or errors in delivery caused by the carrier.
- Delivery Methods
- Right of Withdrawal
- The Customer has the right to withdraw from the contract within 14 days from the date they took possession of the goods (or the date a third party indicated by the Customer took possession) without giving any reason.
- To exercise the right of withdrawal, the Customer must send a statement electronically to: hello@cotty.pl or in writing to the Seller’s registered office.
- Use of the model withdrawal form (available on the Store’s website) is not obligatory. The Store will promptly confirm receipt of the withdrawal statement by email.
- The Customer bears the cost of returning the goods and must do so promptly, no later than 14 days from the withdrawal date.
- The goods should be returned undamaged and in their original packaging.
- The Store will refund payments made by the Customer, including the cost of initial delivery (up to the amount of the cheapest standard delivery method), without undue delay and no later than 14 days from receipt of the withdrawal statement. Refunds will be made using the same payment method used by the Customer, unless the Customer agrees otherwise.
- The Store may withhold refund until it receives the goods back or proof of shipping.
- The Customer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.
- The right of withdrawal does not apply to goods that, after delivery, due to their nature, have been inseparably mixed with other items.

- The Store will address complaints within 14 days of receipt. In case of a justified complaint, the Store will repair, replace the goods, or refund the payment in accordance with applicable regulations.

The Store is not liable for damages resulting from:- Improper use of products by the Customer,
- System or technical errors,
- Store downtime due to failures, maintenance, or other technical reasons,
- Actions of third parties, including carriers.
- Scope of Liability
In no event will the Seller’s liability exceed the value of the order.

- Store Availability and Technical Breaks
- Availability
The Store is available 24 hours a day, 7 days a week. - Technical Breaks
Due to maintenance, system updates, or failures, the Store’s availability may be temporarily limited.
In case of technical breaks, failures, or other disruptions beyond the Seller’s control, the consumer cannot claim compensation for unavailability or inability to make purchases.
The Store is not responsible for technical breaks or disruptions.

- Amendments to the Terms
The Store reserves the right to amend these Terms. The Customer will be informed of any changes at least 14 days in advance by publishing the updated Terms on the Store’s website. The changes become effective after this period unless the Customer objects to the new terms. - Governing Law
Matters not regulated by these Terms shall be governed by Polish and EU law. - Dispute Resolution
Any disputes arising from the application of these Terms will be resolved by the competent court according to the Seller’s registered office.
In case of a dispute, the Customer may use out-of-court consumer dispute resolution methods, such as mediation or arbitration, or the ODR (Online Dispute Resolution) platform, available at: https://ec.europa.eu/consumers/odr. - Entry into Force
These Terms come into effect on February 24, 2025.
